Plain-English summary
- You pay per campus per month (or per the licence you signed for the Custom plan). No per-student metering.
- Your data is yours. You can export it at any time, in standard formats.
- We aim for 99.9% uptime, exclude planned maintenance, and tell you about incidents in plain language.
- You may not use Kampus to break the law, infringe other people's rights, or host content you do not have the right to share.
- Either side can end the agreement on 30 days' notice; we refund pre-paid, unused amounts on a pro-rata basis.
1. Parties
These Terms are between the entity operating Kampus (referred to as “Kampus”, “we”, “us”) and the school, organisation, or individual registering for the service (referred to as “Customer”, “you”, “your”). If you are accepting on behalf of an organisation, you represent that you have authority to bind it.
2. Your account
You must provide accurate information at signup and keep it current. You are responsible for the activity that happens under your user accounts and for keeping your credentials secure. Please tell us promptly if you believe an account has been compromised.
3. Subscription, fees, and billing
Starter and Growth are billed monthly per campus at the prices on our Pricing page. The Custom plan is billed annually under the signed licence. Prices may be updated on 30 days' notice, with changes taking effect at the next renewal. Taxes are added where applicable. Late payment may suspend the service after reasonable notice.
4. Acceptable use
You agree not to:
- Use Kampus to break any law or regulation.
- Upload content you do not have the right to share, or that infringes a third party's rights.
- Attempt to access the service by means other than the interface we provide.
- Reverse engineer, decompile, or attempt to extract source code, except to the extent the law explicitly allows it.
- Interfere with security features or probe the service for vulnerabilities without our written consent.
- Use Kampus to send unsolicited communications or to harass any person.
5. Your data
You retain all rights to the data you put into Kampus. You grant us a limited licence to host, transmit, and process that data for the purpose of delivering the service. We process it under the Data Processing Agreement, which forms part of these Terms.
6. AI features
Kampus.ai is provided as a convenience to help authorised users query their own school data. Outputs are generated, may be incorrect, and should be reviewed by a human before action. You are responsible for decisions taken on the basis of AI output.
7. Service availability
We target 99.9% monthly uptime, measured at the public entry point of the application, excluding scheduled maintenance and factors outside our reasonable control. The current status and incident history are published on our status page. Service credits for sustained downtime on Starter and Growth are described in the Service Level Addendum.
8. Support
Email support is included on every plan. Target first-response time is one business day. The Custom plan includes a dedicated success manager, phone support, and an agreed response window in the signed licence.
9. Changes to the service and the Terms
We may evolve the service over time. If a change materially reduces its functionality, we will give 30 days' notice. We may update these Terms on 30 days' notice; if you do not accept the new Terms, you can end the agreement and we will refund pre-paid, unused amounts on a pro-rata basis.
10. Suspension and termination
We may suspend access if (a) you breach these Terms and do not remedy it within a reasonable cure period, (b) payment is overdue, or (c) we are required to do so by law. Either side may terminate for convenience on 30 days' written notice. On termination, you can export your data during the 30-day grace period before it is deleted under the Privacy Policy.
11. Warranties and disclaimers
We provide Kampus with reasonable skill and care. Except as expressly stated, the service is provided “as is”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.
12. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, or consequential damages. Each party's total liability arising from or related to the service will not exceed the fees paid by you to us in the twelve months before the event giving rise to the claim. Nothing in this section limits liability that cannot be excluded by law (such as death, personal injury, or fraud).
13. Indemnification
You will indemnify us against third-party claims arising from data you upload to Kampus or your use of the service in breach of these Terms. We will indemnify you against third-party claims that the service, as provided, infringes intellectual property rights, subject to the limitations in this agreement.
14. Governing law and disputes
These Terms are governed by the laws of the registered office of the Kampus entity. Disputes are resolved in the courts of that jurisdiction, except that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information.
15. Other terms
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. A party's failure to enforce a right is not a waiver of that right. These Terms, together with the Privacy Policy and the Data Processing Agreement, are the entire agreement between the parties on their subject matter.
